1. Who this is with
On The Round is run by Benjamin Ali, a sole trader in England (“we”, “us”). These terms are between us and you, the business using the service. Contact: hello@ontheround.co.uk.
2. What we provide
A website for your business at a web address we give you, a live map fed by an app on your phone, and — if you switch it on — a way for your customers to order ahead. We host it, keep it running, and keep it up to date.
3. What it costs
- £29 a month, including VAT where it applies.
- The first 30 days are free. We take card details at the start so your site can go live, and nothing is charged until the free month ends.
- Cancel before the free month ends and you pay nothing at all.
- After that it renews monthly until you cancel. Cancel any time, from your own dashboard, without asking us.
- We will give you at least 30 days' notice by email before changing the price.
4. Stopping
Cancel whenever you like. Your site stays up until the end of the month you have paid for, then shows a holding page with your contact details on it — because your web address is painted on a van and people will keep following it. Nothing is deleted. Subscribe again and everything comes back as it was.
Stopping for the winter is the same thing: cancel in October, come back in March, and your menu, photos and stops are waiting.
5. Your content is yours
Your business name, menu, prices, photos and words belong to you. We do not claim any ownership of them. We store and display them only to run your site, and we will send you a copy if you ask.
You are responsible for having the right to use what you upload — including photographs of people, who should be happy to appear on your site.
6. Your customers' data
When somebody orders from your site, their details are yours, not ours. In legal terms you are the controller and we are your processor. This section is the agreement that puts that in writing, and it is required by law.
What we do with it
- We hold order details — name, phone, an email address if they gave one, an address if you deliver — only to run the ordering part of your site.
- We act on your instructions and nothing else. We do not market to your customers, sell their details, or use them to build anything.
- Only people who need it can reach it, and we keep records of account changes.
- We use Cloudflare to host it and Stripe to take your subscription. If we ever add another supplier who touches this data, we will tell you first.
- We will help you if a customer asks for their data or asks to be deleted.
- If data is lost or exposed we will tell you quickly and plainly, so you can meet your own obligations.
- Delete an order and it is gone. Close your account and everything is deleted after 30 days.
What you are responsible for
- Telling your customers what you do with their details — we put a short notice on your site to cover the basics, but it is your notice and you should read it.
- Only asking for what you need to fulfil the order.
7. Where your van is
The app records nothing between you pressing stop and pressing start, and we keep only your current position, never a history. This is a promise about how the software is built, not a setting — you can read the detail in our privacy notice.
8. Using it properly
Please do not use On The Round to:
- sell anything you are not lawfully allowed to sell;
- impersonate another business;
- publish anything unlawful, or anything you do not have the right to publish;
- track a person who has not agreed to it — the app goes on a phone belonging to somebody who knows it is there;
- attack, overload or break the service for other people.
If any of that happens we may suspend the account. Where we can, we will ask first.
9. What we promise, and what we do not
We will do our best to keep everything running, and we fix things quickly. But we are a small operation and we do not promise the service will never be unavailable — the internet, phone networks and GPS all fail sometimes, and when they do your map will be wrong or absent.
Do not rely on the map alone for anything that matters. It tells your customers roughly where you are; it is not a safety system and it is not a substitute for telling somebody where you will be.
10. If something goes wrong
If we fail you and it costs you money, our liability to you is limited to what you have paid us in the previous twelve months. We do not exclude liability for anything the law does not let us exclude — including death or personal injury caused by our negligence, or fraud.
These terms are for businesses. If you are buying as a consumer, your legal rights are not affected by anything here.
11. Changes
We may change these terms. If a change materially affects you, we will email you at least 30 days beforehand, and you can cancel before it takes effect without penalty.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
